Claims, Returns and Exchanges

I. BED TESTING – You have 90 days from the date of purchase

1. A customer who is a consumer within the meaning of the law may return goods purchased via the online store [www.miaandlou.com](http://www.miaandlou.com) under the terms set out below.
2. To exercise this right, the Consumer should send an appropriate statement in writing or electronically to the address [biuro@miaandlou.pl](mailto:biuro@miaandlou.pl) within 90 days from the date of receiving the goods purchased from the Seller. To meet the deadline, it is sufficient to send the statement of intent to return the goods before the deadline expires. The above form must include the reason for returning the purchased goods.
3. The Seller is obliged to promptly refund the payment received from the Consumer, no later than within 14 days from the date of receiving the statement of intent to return the goods, excluding the cost of shipping the ordered goods. The customer must provide the necessary data to process the refund.
4. The Seller does not cover the cost of returning the goods to the online store.
5. The Seller will issue the refund using the same payment method that the Consumer used, unless the Consumer agrees to another method in accordance with the return form mentioned in point 2.
6. The Consumer is obliged to return the goods to the Seller promptly, but no later than within 14 days from the date they informed the Seller about the intent to return the goods. The cost of returning the goods to the online store is borne by the Consumer.
7. The Seller may withhold the refund until receiving the returned goods from the customer. The Consumer has 14 days from the date of withdrawal from the contract to return the goods.
8. Goods returned by the Consumer should be properly packed to avoid damage during transport. Returned goods must be in a condition suitable for further use—i.e., they must not show signs of excessive wear (permanently damaged beams, scratched or broken parts, etc.). The goods must be returned in complete condition, along with all documents issued at the time of sale, to the address: Kidsari sc, 80-346 Gdańsk, ul. Wejhera 16A.
9. The Consumer is liable for any decrease in the value of the goods resulting from handling them in a way that exceeds what is necessary to determine their nature.

II. RIGHT OF WITHDRAWAL – 14 days from the date of purchase

1. A customer who is a consumer within the meaning of the applicable law may withdraw from a distance contract concluded via the online store [www.miaandlou.com](http://www.miaandlou.com) without giving any reason.
2. To exercise this right, the Consumer should send an appropriate statement in writing or electronically to [biuro@miaandlou.pl](mailto:biuro@miaandlou.pl) within 14 days from the date of receiving the goods purchased from the Seller. To meet the deadline, it is sufficient to send the withdrawal statement on time before the deadline expires.
3. The Seller is obliged to promptly, no later than within 14 days from the date of receiving the withdrawal statement, refund the Consumer all payments made by them, excluding delivery costs of the ordered goods. The customer must provide the necessary data for the refund.
4. The Seller does not cover the cost of returning the goods to the online store.
5. The Seller will issue the refund using the same payment method used by the Consumer, unless the Consumer agrees to another method according to the withdrawal form mentioned in point 2.
6. The Consumer is obliged to return the goods promptly, but no later than within 14 days from the date of informing the Seller of the intent to withdraw from the contract. The cost of returning the goods is borne by the Consumer.
7. The Seller may withhold the refund until receiving the returned goods. The Consumer has 14 days from the date of withdrawal to return the goods.
8. Goods returned by the Consumer must be properly packed to avoid transport damage. Returned goods must be in an unused condition—i.e., they must not show any signs of use. The goods must be returned complete, along with all sales documents, to the address: Kidsari sc, 80-346 Gdańsk, ul. Wejhera 16A, POLAND.
9. The Consumer is responsible for any reduction in the value of the product resulting from handling it in a way that exceeds what is necessary to determine its nature, characteristics, and functioning.
10. According to Article 38 of the Act, the right to withdraw from a distance contract does not apply to contracts:

* for the provision of services if the seller has fully performed the service with the consumer’s explicit consent, and the consumer was informed before the service began that they would lose the right to withdraw once the service was completed;
* where the subject of the contract is a non-prefabricated item made according to the consumer’s specifications or serving to meet their individual needs;
* where the subject of the contract is an item liable to deteriorate rapidly or with a short shelf life;
* where the item is delivered in sealed packaging and, once opened, cannot be returned for health or hygiene reasons;
* where the products, due to their nature, become inseparably connected with other items after delivery.

 

III. TRANSPORT DAMAGE AND PRODUCT DEFECTS – 7 days from the date of purchase

1. A customer who is a consumer within the meaning of the law, making a distance purchase via the online store [www.miaandlou.com](http://www.miaandlou.com), has the right to exchange any parts of the product that were damaged or defective during transport.
2. To exercise this right, the Consumer should send an appropriate statement in writing or electronically to [biuro@miaandlou.pl](mailto:biuro@miaandlou.pl) immediately after identifying the defect, but no later than within 7 days from the date of delivery of the goods. To meet the deadline, it is sufficient to send the defect notification on time.
3. A valid defect notification must specify the defective element according to the assembly manual and include photos of the damage.
4. After positively reviewing the defect notification, the Seller will promptly, no later than within 14 days from receiving the correctly completed notification, send replacement parts free of defects at their own cost.
5. The Consumer is not required to send the defective parts back to the Seller.
6. The Consumer must not use the bed with defective parts. Assembling or using the bed with defective components constitutes grounds for rejecting the claim.
7. In justified cases, the Consumer may be required to complete a complaint form provided by the transport company to properly report the defect.
8. The Consumer is not entitled to a refund of the purchase price for a defective product unless otherwise agreed between the parties.
